HeadshotPro AI provides an artificial intelligence-powered service that generates professional headshot photographs from user-uploaded images. The Service uses third-party AI models to transform casual photos into professional-quality headshots.

3. User Requirements

  • You must be at least 18 years old to use this Service
  • You must provide accurate information when using the Service
  • You are responsible for maintaining the confidentiality of your order information
  • You must have the legal right to upload any photos you submit

4. Acceptable Use

You agree NOT to:

  • Upload images of anyone without their consent
  • Upload images of minors
  • Upload inappropriate, offensive, or illegal content
  • Use the Service for fraudulent or deceptive purposes
  • Attempt to reverse engineer or exploit the Service
  • Use generated images to impersonate others or for identity fraud
  • Resell or redistribute the Service without authorization

5. Image Rights & Ownership

5.1 Your Images

You retain ownership of the original photos you upload. By uploading images, you grant us a limited license to process them for the purpose of generating your headshots.

5.2 Generated Headshots

Upon successful payment, you receive a perpetual, non-exclusive license to use the generated headshots for personal and commercial purposes, including but not limited to: social media profiles, resumes, professional websites, and marketing materials.

6. Payment & Pricing

  • All prices are displayed in USD and include applicable taxes where required
  • Payment is processed securely through Stripe
  • You will be charged at the time of purchase
  • We reserve the right to modify pricing at any time

7. Refund Policy

Due to the nature of AI-generated content, refunds are handled on a case-by-case basis:

  • Technical Failure: Full refund if we fail to deliver any headshots
  • Quality Issues: We may offer regeneration or partial refund at our discretion
  • Buyer's Remorse: No refunds for completed orders where headshots were successfully delivered

8. AI-Generated Content Disclaimer

The headshots generated by our Service are created using artificial intelligence. While we strive for high quality and accuracy, we cannot guarantee:

  • Perfect likeness to the original photos
  • Specific styling requests will be followed exactly
  • Results will meet all user expectations
  • Generated images are free from AI artifacts or imperfections

9. Third-Party Services

Our Service relies on third-party providers including but not limited to:

  • Replicate, Inc. - AI model hosting and processing
  • OpenAI - AI image generation technology
  • Stripe, Inc. - Payment processing

Your use of our Service is also subject to the terms and policies of these third-party providers.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEADSHOTPRO AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid for the Service in question.

11. Indemnification

You agree to indemnify and hold harmless HeadshotPro AI and its affiliates from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We reserve the right to terminate or suspend access to our Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which HeadshotPro AI operates, without regard to conflict of law principles.
